These Terms & Conditions govern your access to DonCapi.com and your purchase and use of products and services offered by DonCapi Signature™.

Please read these Terms carefully before using our website or placing an order.

By accessing DonCapi.com, creating an account, placing an order, or otherwise using our website, you agree to be bound by these Terms together with our Privacy Policy, Shipping & Delivery Policy, Returns & Refunds Policy, and any additional terms expressly presented in connection with a particular product or promotion.

1. Who We Are

In these Terms, “DonCapi”, “DonCapi Signature™”, “we”, “us” and “our” refer to Frank Carew trading as DonCapi Signature™.

“You” and “your” refer to the person accessing the website, creating an account or purchasing products from DonCapi.

2. United States Customers

DonCapi currently sells and ships products to delivery addresses within the United States only.

Our website may be accessible from other countries, but accessibility does not mean that products are available for delivery outside the United States.

We reserve the right to restrict or refuse orders that cannot be lawfully or operationally delivered to the destination supplied by the customer.

3. Acceptance of These Terms

By using DonCapi.com or placing an order, you confirm that:

  • you have read and understood these Terms;
  • you agree to be bound by these Terms;
  • you are legally capable of entering into the transaction; and
  • the information you provide is accurate to the best of your knowledge.

If you do not agree to these Terms, you should not place an order or continue using services that require acceptance of them.

4. Legal Capacity

You must be legally capable of entering into a binding purchase contract.

If you are under the age of legal majority in your jurisdiction, purchases should be made by or with the involvement and permission of a parent or legal guardian who is legally capable of entering into the transaction.

DonCapi.com is not intended to enable children to enter into legally binding commercial contracts independently.

5. Our Products

DonCapi offers branded headwear and related products displayed on DonCapi.com.

Product pages may include information concerning:

  • design;
  • colour;
  • style;
  • materials;
  • construction;
  • embroidery;
  • fit;
  • product variants;
  • production;
  • shipping; and
  • care.

Customers should review the applicable product page before placing an order.

6. Made-to-Order Products

DonCapi products are generally produced after a customer places an order.

This means products may enter production specifically for that customer rather than being taken from conventional pre-produced retail stock.

Once production has started, it may no longer be technically or commercially possible to cancel or alter the product.

Our made-to-order model is explained further in our Returns & Refunds Policy.

7. Third-Party Product Production and Fulfilment

DonCapi uses a third-party product production and fulfilment network to manufacture, decorate, package and ship products.

These providers operate as part of DonCapi’s supply and fulfilment infrastructure.

Your purchase contract for DonCapi products is with DonCapi Signature™, not with our production or fulfilment provider.

We may provide the production and fulfilment network with information reasonably necessary to manufacture and deliver your order.

Information concerning our handling of personal data is explained in our Privacy Policy.

8. Product Availability

All products are subject to availability.

Product availability may change because of:

  • supplier inventory;
  • colour or variant availability;
  • production capacity;
  • manufacturer changes;
  • product discontinuation;
  • material availability;
  • technical limitations; or
  • other circumstances affecting production.

Adding a product to your cart or wishlist does not reserve that product or guarantee future availability.

If an ordered product becomes unavailable and cannot reasonably be fulfilled, we may cancel the affected item or order and provide the appropriate refund.

9. Product Images

We make reasonable efforts to present products accurately.

However, product images may include digital mockups, rendered previews or photography.

The appearance of a physical product may vary slightly because of factors including:

  • screen settings;
  • monitor calibration;
  • lighting;
  • photography;
  • digital rendering;
  • fabric texture;
  • thread texture;
  • embroidery;
  • manufacturing tolerances; and
  • individual production batches.

Minor differences that do not materially change the product are not necessarily defects.

This provision does not excuse a materially incorrect, defective, damaged or misrepresented product.

10. Embroidery and Production Variations

Embroidery is a physical production process and may involve reasonable minor variations between individual products.

These may include minor differences in:

  • stitch texture;
  • thread appearance;
  • design placement;
  • thread colour;
  • fabric alignment; and
  • the way embroidery sits on different product shapes.

Reasonable production variation is not automatically considered a manufacturing defect.

Material errors, including substantially incorrect artwork, missing decoration, major embroidery failure or an incorrect product, remain subject to our Returns & Refunds Policy.

11. Product Materials and Manufacturer Changes

Product manufacturers may occasionally update:

  • materials;
  • labels;
  • construction;
  • packaging;
  • minor design details; or
  • manufacturing locations.

We make reasonable efforts to keep product information current.

Where a manufacturer makes a minor change that does not materially alter the essential nature of the product, existing product information may not always reflect that change immediately.

12. Country of Origin and United States Production

Some DonCapi products may be decorated, embroidered, printed, processed or fulfilled within the United States.

This does not necessarily mean that every blank product, fabric, component or material was manufactured in the United States.

Unless a specific product page expressly makes a substantiated country-of-origin statement, DonCapi does not make an unqualified representation that a product is “Made in USA”.

The country of manufacture of a blank product may differ from the country in which DonCapi decoration, embroidery, printing or fulfilment takes place.

13. Prices

Unless otherwise stated, prices displayed on DonCapi.com are shown in United States dollars (USD).

Prices may change from time to time.

A price change does not affect an order that has already been accepted, except where:

  • there is an obvious or material pricing error;
  • the transaction must be corrected by law; or
  • the customer agrees to the change.

We reserve the right to correct pricing errors before fulfilling an affected order.

If a material pricing error affects an order that cannot reasonably be honoured, we will notify the customer and provide an appropriate cancellation and refund where required.

14. Taxes

Applicable sales tax or other legally required charges may be added during checkout where DonCapi is required to collect them.

The amount may depend on factors including the customer’s delivery address and applicable tax law.

Any tax or other mandatory charge collected by DonCapi will be displayed as part of the checkout total where reasonably required by the applicable system and law.

15. Shipping Charges

Where shipping charges apply, they will be displayed during checkout before the customer completes the purchase.

Where a qualifying promotion provides free shipping, the applicable shipping amount may be shown as zero or otherwise identified during checkout.

Shipping arrangements are governed by our Shipping & Delivery Policy.

16. Promotions, Discounts and Coupon Codes

DonCapi may offer:

  • discount codes;
  • sales;
  • promotional prices;
  • free shipping;
  • multi-buy promotions; or
  • other limited offers.

Promotions may be subject to specific conditions displayed with the offer.

Unless otherwise stated:

  • promotions are available for a limited period;
  • promotions have no cash value;
  • discount codes cannot be exchanged for cash;
  • multiple promotions may not necessarily be combined;
  • a discount must be entered or applied before completing payment where required;
  • promotions may be restricted to particular products, customers or orders; and
  • DonCapi may end a promotion before a new order is placed.

We will not retrospectively withdraw a valid promotion from an order already accepted under that promotion except where fraud, abuse or an obvious technical error occurred.

17. Promotional Errors

If a promotion is displayed incorrectly because of an obvious technical, typographical or system error, DonCapi may correct the error.

If an affected order cannot reasonably be honoured as displayed, we may contact the customer and either:

  • offer the correct terms and request agreement; or
  • cancel the affected order and provide the appropriate refund.

18. Wishlists

Wishlist functionality is provided for convenience.

Saving an item to a wishlist:

  • does not reserve the item;
  • does not guarantee availability;
  • does not lock the price;
  • does not create a purchase contract; and
  • does not guarantee that a promotion will remain available.

19. Placing an Order

Before placing an order, customers should review:

  • the product;
  • design;
  • colour;
  • variant;
  • quantity;
  • price;
  • shipping address;
  • shipping method;
  • applicable shipping charges;
  • taxes where applicable; and
  • the final order total.

You are responsible for reviewing this information before completing the transaction.

The checkout process provides an opportunity to review and, where technically available, correct order information before payment is submitted.

20. Payment Obligation

Submitting an order using the final purchase or payment control indicates that you are placing an order that carries an obligation to pay the amount displayed at checkout.

You should not submit an order unless you intend to complete the purchase.

21. Order Acknowledgement and Acceptance

After an order is submitted, DonCapi may send electronic confirmation containing the order details.

A purchase contract is normally formed when:

  • the order has been submitted;
  • payment has been successfully authorised or otherwise accepted; and
  • DonCapi sends confirmation that the order has been accepted or confirmed.

An order remains subject to these Terms and to DonCapi’s rights concerning fraud, material pricing errors, product unavailability, unlawful transactions and other circumstances expressly described in these Terms.

22. Order Confirmation

Customers should retain their order-confirmation email and order number.

The order confirmation may contain important information concerning:

  • products purchased;
  • prices;
  • delivery information;
  • payment;
  • order status; and
  • customer support.

23. Payment Methods

DonCapi currently supports payments through:

  • Stripe;
  • PayPal; and
  • Google Pay.

Availability of individual payment methods may depend on:

  • device;
  • browser;
  • payment provider;
  • customer eligibility;
  • transaction value;
  • payment-provider risk controls; and
  • other technical or regulatory requirements.

24. Payment Providers

Payments are processed through independent payment providers.

Those providers may apply their own:

  • terms;
  • privacy policies;
  • security controls;
  • fraud-prevention systems;
  • authentication requirements; and
  • transaction rules.

DonCapi does not control a payment provider’s independent systems or decisions.

If a payment provider declines or reverses a payment, DonCapi may be unable to accept or continue processing the affected order.

25. Payment Authorisation

By providing or selecting a payment method, you confirm that you are authorised to use that payment method for the transaction.

DonCapi may cancel an order where payment:

  • cannot be authorised;
  • is reversed;
  • is identified as potentially fraudulent;
  • is disputed before fulfilment;
  • fails security checks; or
  • cannot otherwise lawfully be processed.

26. No Recurring Subscription Charges

DonCapi does not currently sell products through a recurring subscription or automatic-renewal programme.

A standard DonCapi product purchase authorises payment for the order displayed at checkout and does not authorise DonCapi to begin charging the customer automatically for future merchandise.

If DonCapi introduces a recurring programme in the future, the applicable recurring-payment terms, frequency, amount, consent requirements and cancellation procedure will be disclosed separately before enrolment.

27. Cancelling or Changing an Order

Because products are made to order, customers should contact DonCapi immediately if they need to request an order change or cancellation.

If production has not started, we will make reasonable efforts to make the requested change or cancellation.

Once production has started, cancellation or modification may no longer be possible.

Submitting a cancellation or amendment request does not guarantee that it can be completed.

28. Cancellation by DonCapi

DonCapi may cancel all or part of an order where reasonably necessary because:

  • a product is unavailable;
  • production cannot be completed;
  • a product has been discontinued;
  • a delivery address cannot be serviced;
  • payment cannot be authorised;
  • fraud or unauthorised payment is reasonably suspected;
  • a material pricing or technical error has occurred;
  • the order violates applicable law;
  • the order violates these Terms; or
  • another circumstance makes lawful fulfilment impossible.

Where DonCapi cancels an order that has been paid and the customer is entitled to a refund, we will provide the appropriate refund.

29. Fraud Prevention

DonCapi reserves the right to perform reasonable fraud and security checks.

An order may be delayed, held, cancelled or refunded where reasonably necessary to investigate:

  • suspected payment fraud;
  • unauthorised payment;
  • identity inconsistencies;
  • suspicious account activity;
  • unusual transaction activity;
  • suspected abuse of promotions;
  • suspected refund fraud; or
  • other security concerns.

We may request reasonable information needed to verify an order before submitting it to production.

30. Chargebacks and Payment Disputes

If you believe there is a problem with an order, we encourage you to contact DonCapi first so that we have an opportunity to investigate and resolve the matter.

Nothing in these Terms prevents you from exercising a lawful right to dispute a qualifying transaction with your card issuer, PayPal, Google Pay provider or other payment institution.

If a payment dispute is submitted, DonCapi may provide relevant order, delivery, communication and transaction records to the payment provider for the purpose of responding to that dispute.

Customers must not knowingly submit false, duplicate or fraudulent payment disputes.

31. Shipping and Delivery

Orders are subject to our Shipping & Delivery Policy.

Because products are made to order, production time and carrier delivery time are separate stages.

Any delivery estimate displayed by DonCapi should be read together with our Shipping & Delivery Policy.

Unless expressly identified as guaranteed, estimated delivery dates are estimates rather than guaranteed arrival dates.

32. Shipping Delays

DonCapi will maintain a reasonable basis for shipping timeframes communicated to customers.

If DonCapi becomes unable to ship merchandise within an applicable promised shipping period, we will take the steps required by applicable law.

Depending on the circumstances, this may include:

  • notifying the customer of the delay;
  • providing a revised shipping estimate where reasonably available;
  • requesting consent to the delay;
  • allowing cancellation of affected unshipped merchandise; and
  • issuing a prompt refund where required.

33. Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

This should include all information reasonably necessary for successful delivery, including where applicable:

  • recipient name;
  • street address;
  • apartment, suite or unit number;
  • city;
  • state;
  • ZIP Code; and
  • other carrier-required information.

Please review the shipping address carefully before submitting your order.

34. Incorrect Customer Information

DonCapi is not responsible for an avoidable delivery failure caused solely by materially incorrect or incomplete shipping information supplied by the customer.

If the error was caused by DonCapi or our fulfilment network, DonCapi will arrange an appropriate correction without charging the customer for our error.

35. Returns and Refunds

All returns, replacements, cancellations and refunds are governed by our Returns & Refunds Policy.

Because DonCapi products are made to order, correctly produced non-defective merchandise is not normally eligible for return, exchange or refund solely because of change of mind or an incorrect customer selection once production has begun.

This does not affect rights relating to:

  • damaged merchandise;
  • defective merchandise;
  • materially incorrect merchandise;
  • undelivered merchandise;
  • unauthorised transactions;
  • misrepresentation; or
  • any other consumer right that applicable law does not permit us to exclude.

36. Customer Accounts

Customers may be able to create an account on DonCapi.com.

You are responsible for providing accurate account information and keeping it reasonably current.

An account is personal to the account holder and should not be used to impersonate another person.

37. Account Security

You are responsible for taking reasonable steps to protect:

  • your password;
  • your email account;
  • your device;
  • your login credentials; and
  • other information used to access your DonCapi account.

38. Account Suspension or Closure

DonCapi may temporarily restrict, suspend or close an account where reasonably necessary because of:

  • fraud;
  • suspected unauthorised access;
  • security concerns;
  • abusive activity;
  • repeated violation of these Terms;
  • unlawful activity;
  • payment fraud;
  • attempted interference with the website; or
  • another legitimate security or legal reason.

Account closure does not eliminate outstanding payment obligations, order records or other information we are legally entitled or required to retain.

39. Prohibited Use of DonCapi.com

You must not use DonCapi.com:

  • for unlawful or fraudulent purposes;
  • to impersonate another person;
  • to submit false payment information;
  • to distribute malware or malicious code;
  • to attack or interfere with website security;
  • to obtain unauthorised access to accounts or systems;
  • to interfere with another customer’s use of the website;
  • to scrape or harvest personal information unlawfully;
  • to circumvent technical access controls;
  • to exploit promotions fraudulently;
  • to attempt fraudulent refunds or chargebacks;
  • to infringe intellectual-property rights; or
  • for any other activity prohibited by applicable law.

40. Automated Access and Scraping

Except where permitted by law or expressly authorised by DonCapi, you must not use automated systems to:

  • extract substantial portions of website content;
  • harvest customer information;
  • circumvent access controls;
  • overload website infrastructure; or
  • interfere with the normal operation of DonCapi.com.

Ordinary search-engine indexing and other legitimate automated access consistent with published website controls is not prohibited by this section.

41. Customer Communications and Submitted Content

You may provide information or content to DonCapi through contact forms, support requests, order communications or other website functions.

You remain responsible for information and materials you submit.

You must not knowingly submit content that:

  • is unlawful;
  • infringes another person’s rights;
  • contains malicious software;
  • is fraudulent;
  • is threatening or abusive;
  • contains another person’s confidential information without permission; or
  • is otherwise intended to damage DonCapi or another person.

You grant DonCapi permission to use submitted material only to the extent reasonably necessary to process the relevant order, provide customer support, investigate a complaint, protect legal rights or otherwise provide the service for which the material was supplied.

Submitting material through customer support does not automatically grant DonCapi a right to use that material for unrelated advertising or marketing.

42. Intellectual Property

Unless otherwise stated, the material appearing on DonCapi.com is owned by, created for, or licensed to DonCapi.

This may include:

  • brand artwork;
  • logos;
  • graphics;
  • product designs;
  • photographs;
  • product descriptions;
  • written content;
  • website graphics;
  • layout elements; and
  • other original creative material.

Applicable copyright, trademark and other intellectual-property laws may protect these materials.

43. DonCapi Trademarks and Branding

DonCapi Signature™, DonCapi branding, logos, marks, designs and associated brand identifiers may be protected by trademark, passing-off, copyright or other intellectual-property rights.

The use of the ™ symbol identifies marks claimed by DonCapi and does not by itself represent that a mark has been formally registered in every jurisdiction.

You may not use DonCapi branding in a way that falsely:

  • suggests endorsement;
  • suggests affiliation;
  • suggests sponsorship;
  • suggests partnership;
  • creates customer confusion; or
  • misrepresents the source of goods or services.

44. Limited Personal Use

You may view and use DonCapi.com for ordinary personal shopping and informational purposes.

Unless authorised by DonCapi or permitted by law, you may not reproduce, distribute, commercially exploit or republish substantial DonCapi website content or brand assets.

45. Third-Party Rights

Third-party names, trademarks, payment marks and other intellectual property appearing on DonCapi.com remain the property of their respective owners.

The appearance of a third-party payment method, service or technology does not transfer ownership of that third party’s intellectual property to DonCapi.

46. Third-Party Websites and Services

DonCapi.com may contain links to or integrations with independent third-party websites or services.

These may include:

  • payment providers;
  • shipping services;
  • social platforms;
  • technical services; or
  • other external resources.

Third-party services operate under their own terms and privacy policies.

DonCapi is not responsible for the content, availability, privacy practices or independent conduct of third-party websites that we do not control.

47. Website Availability

We aim to keep DonCapi.com available and functioning properly.

However, we do not guarantee uninterrupted or error-free access at all times.

The website may occasionally be unavailable because of:

  • maintenance;
  • software updates;
  • security work;
  • hosting issues;
  • network failures;
  • third-party outages;
  • technical problems; or
  • events outside our reasonable control.

We may temporarily suspend website functionality where reasonably necessary to maintain security or reliability.

48. Errors and Corrections

We make reasonable efforts to ensure that information on DonCapi.com is accurate.

However, occasional typographical, technical, pricing, availability or descriptive errors may occur.

We may correct an error when discovered.

If a material error affects an existing order, we will handle the affected order fairly and in accordance with these Terms and applicable law.

49. No Professional Advice

General information appearing on DonCapi.com is provided in connection with our products and store.

It should not be relied upon as legal, tax, financial, medical or other regulated professional advice.

50. Consumer Product Rights

Nothing in these Terms is intended to remove, restrict or waive a consumer right that applicable law does not allow DonCapi to exclude.

If a mandatory consumer-protection law gives you greater protection than a provision of these Terms, that mandatory protection will apply to the extent of any conflict.

51. Disclaimer of Additional Warranties

DonCapi will provide products in accordance with the descriptions, commitments and legal obligations applicable to the transaction.

To the fullest extent permitted by law, DonCapi does not provide additional guarantees or warranties beyond:

  • those expressly stated by DonCapi;
  • those expressly provided with the product; and
  • those that applicable law does not allow us to exclude.

Nothing in this section excludes liability for a product that is materially defective, misdescribed or otherwise subject to a mandatory legal remedy.

52. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms is intended to exclude or limit liability for:

  • fraud or fraudulent misrepresentation;
  • death or personal injury where liability cannot lawfully be excluded;
  • wilful misconduct where liability cannot lawfully be excluded;
  • mandatory product liability;
  • mandatory consumer rights; or
  • any other liability that applicable law does not permit DonCapi to exclude or restrict.

To the fullest extent permitted by law, DonCapi is not responsible for losses that are:

  • not reasonably foreseeable when the contract was made;
  • caused solely by information supplied incorrectly by the customer;
  • caused solely by unlawful customer activity;
  • caused by circumstances outside our reasonable control where applicable law permits such limitation; or
  • business losses arising from a purchase made primarily for commercial or resale purposes rather than ordinary consumer use.

53. Customer Responsibility

You are responsible for losses or consequences resulting from your own:

  • fraudulent conduct;
  • unlawful use of DonCapi.com;
  • unauthorised use of another person’s payment method;
  • intentional interference with website systems;
  • infringement of another person’s rights; or
  • material breach of these Terms.

This section does not make a customer responsible for losses caused by DonCapi’s own breach, negligence or other conduct for which DonCapi is legally responsible.

54. Events Outside Our Reasonable Control

DonCapi may be affected by events outside our reasonable control, including:

  • extreme weather;
  • natural disasters;
  • fire;
  • flooding;
  • war;
  • civil unrest;
  • government restrictions;
  • public emergencies;
  • labour disputes;
  • carrier disruption;
  • transportation failures;
  • material shortages;
  • production facility disruption;
  • power failures;
  • internet or telecommunications failures; or
  • widespread technical incidents.

Where such an event affects an order, we will take reasonable steps to reduce disruption.

This section does not remove any cancellation, refund or other right that applicable law gives the customer.

55. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

Among other matters, the Privacy Policy explains:

  • what information we collect;
  • why we collect it;
  • payment and fulfilment disclosures;
  • international transfers;
  • retention;
  • security;
  • cookies;
  • U.S. privacy rights; and
  • how to contact us about privacy.

56. Electronic Communications

When you place an order, create an account or contact DonCapi electronically, communications between you and DonCapi may take place electronically.

These communications may include:

  • order confirmations;
  • payment notices;
  • shipping notices;
  • refund notices;
  • account messages;
  • security notices;
  • customer-support communications; and
  • legally required notices where electronic delivery is permitted.

You are responsible for providing a valid email address and maintaining access to that address while an order or account remains active.

57. Transactional Communications Only

DonCapi currently sends transactional and service-related emails rather than promotional email marketing.

Transactional communications may be necessary to administer your account or complete an order.

If DonCapi introduces promotional email marketing in the future, any legally required consent and opt-out processes will be implemented separately.

If you have a complaint about a DonCapi order or service, please contact us so that we have an opportunity to investigate.

59. Informal Resolution of Disputes

Before starting formal legal proceedings, we encourage customers to contact DonCapi and provide a reasonable opportunity for the matter to be investigated and resolved.

This informal process does not prevent you from exercising a legal right, payment-dispute right or regulatory complaint right where applicable.

60. Governing Law

DonCapi Signature™ is operated by a sole trader established in England.

These Terms and any non-contractual obligations arising from or connected with them are governed by the laws of England and Wales, except to the extent that mandatory consumer-protection law applicable to you provides rights that cannot lawfully be waived by a choice-of-law provision.

For a United States consumer, nothing in this section is intended to remove mandatory consumer rights provided by applicable federal or state law.

61. Jurisdiction

The courts of England and Wales shall have non-exclusive jurisdiction over disputes arising from these Terms.

However, this provision does not prevent a consumer from bringing proceedings in another court that has jurisdiction where applicable mandatory law permits or requires that right.

62. No Mandatory Arbitration Provision

These Terms do not currently require customers to submit disputes to private mandatory arbitration instead of a court.

DonCapi may agree to mediation, arbitration or another alternative dispute-resolution process voluntarily with a customer after a dispute arises where both parties agree to do so.

63. Severability

If a court or other competent authority determines that part of these Terms is invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally permitted.

The remaining provisions will continue to apply to the extent legally possible.

64. No Waiver

If DonCapi does not immediately enforce a provision of these Terms, that does not automatically mean that we have permanently waived the provision or our right to enforce it later.

Any waiver applies only to the specific circumstances in which it was given unless expressly stated otherwise.

65. Assignment

You may not transfer an outstanding customer order or your obligations under these Terms to another person in a way that materially affects DonCapi without our agreement.

DonCapi may transfer its rights and obligations as part of a legitimate sale, transfer or reorganisation of the business, provided that doing so does not unlawfully reduce an existing customer’s rights.

66. Entire Agreement

These Terms, together with the policies expressly incorporated into them and any specific product or promotional terms disclosed before purchase, form the agreement between DonCapi and the customer concerning the relevant website use or transaction.

The policies incorporated into these Terms include:

  • Privacy Policy;
  • Shipping & Delivery Policy; and
  • Returns & Refunds Policy.

Where specific promotional or product terms clearly conflict with these general Terms, the specific terms will apply to that promotion or product to the extent of the conflict, provided they are lawful.

67. Interpretation

Headings are provided for convenience and do not change the meaning of these Terms.

Words including “including”, “includes” and similar expressions are illustrative and do not limit the words preceding them.

References to legislation or legal rights include applicable amendments, replacements or successor provisions where appropriate.

68. Changes to These Terms

DonCapi may update these Terms from time to time because of changes in:

  • law;
  • regulation;
  • business operations;
  • products;
  • payment methods;
  • production arrangements;
  • fulfilment arrangements;
  • website functionality;
  • security requirements; or
  • other operational requirements.

The current version will display its Effective Date and Last Updated date at the top of this page.

Changes will normally apply prospectively.

A later change to these Terms will not retrospectively remove a consumer right that has already arisen and cannot lawfully be removed.

69. Terms Applying to Existing Orders

Unless applicable law requires otherwise, the Terms and policies in effect when an order is accepted will normally govern that order.

Later updates to general website terms will not normally alter the essential contractual terms of an already accepted order without an appropriate legal basis or customer agreement.
